Terms of Service

These Terms of Service ("Terms") govern your use of tokencheat.com and the TokenCheat tools and services (together, the "Service"), operated by TokenCheat ("we," "us"). By using the Service you agree to these Terms. If you do not agree, do not use the Service.

Plain-English summary: Use the tools honestly, our cost numbers are estimates not promises, your pasted configs stay in your browser unless you explicitly opt in to saving them, paid audits have a no-hassle refund, and we can each walk away — you by deleting your account, us by giving you reasonable notice.

1. Who may use the Service

You must be at least 16 years old. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization, and "you" includes it.

2. What the Service is

TokenCheat provides cost-visibility and configuration-hygiene tooling for AI-assisted software development: free browser-based calculators and audits, optional user accounts with saved audit reports, a local command-line tool ("CLI"), and paid one-time audit services. The Service is provided on a reasonable-efforts basis; we do not guarantee uninterrupted availability.

Estimates are not advice. Scores, token counts, cost figures, and savings estimates produced by the Service are deterministic heuristics based on stated assumptions and published provider list prices. They are informational only — they are not financial, accounting, tax, or legal advice, and they are not a guarantee of any saving. Verify material figures against your provider invoices.

3. Your content and how it is processed

  • Browser tools: content you paste into the free audit tools is processed entirely in your browser and is not transmitted to our servers.
  • Saved reports: if you have an account and save an audit, we store the scores and fix summaries. The content of your instruction file is stored only if you explicitly enable the "include my optimized file" option.
  • CLI: the CLI analyzes files on your machine. It transmits data to us only if you run its sync command with your API key, and then only summary telemetry (token counts, scores, model identifiers) — never your source code.
  • Shared report links: you may generate a public link to a saved report. Anything in that report (including opted-in file content) is visible to anyone with the link until you disable sharing.

You retain all rights to your content. You grant us the limited license needed to store and display it as described above and at your direction.

4. Accounts

Keep your credentials secure; you are responsible for activity under your account. Provide accurate information. We may suspend or terminate accounts that violate these Terms, with notice where reasonable.

5. Free tier, subscriptions, and paid audits

  • Free tier: free tools are unlimited; saved audits are limited (currently 3 per month) and limits may change.
  • Subscriptions (where offered): billed in advance via our payment processor; cancel any time from your billing page, effective at the end of the current period. We will give at least 30 days' notice of price increases.
  • Paid one-time audit services: priced as stated at checkout, payable in advance via a third-party hosted checkout. We aim to deliver within two business days of receiving your materials. Refund policy: if you are not satisfied with a delivered audit, tell us within 14 days and we will refund it in full. Prices may include limited-time founding discounts; the price you pay is the price shown at your checkout.
  • Taxes may be collected by our payment processor where applicable.

6. API keys and acceptable use

API keys identify your workspace; keep them secret and rotate them if exposed. We may rate-limit or revoke keys that endanger the Service.

You agree not to: break the law; probe, breach, or overload the Service; scrape or resell it without permission; misrepresent audit outputs as our endorsement; upload malicious code; or use the Service to build a substantially similar competing dataset by systematic extraction.

7. Intellectual property

The Service, including its software, scoring methodology, brand, and content (other than your content), is owned by TokenCheat and protected by law. We grant you a limited, non-exclusive, revocable license to use it as intended. Published reports and blog content may be quoted with attribution and a link.

8. Privacy

Our Privacy Policy describes what we collect and your rights, including under GDPR and CCPA. Summary: we collect the minimum needed (account email, saved audit data, opt-in telemetry, cookieless-by- default analytics), we do not sell personal information, and you can access or delete your data.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT ESTIMATES, SCORES, OR OPTIMIZED FILES ARE ACCURATE, COMPLETE, OR SUITABLE FOR YOUR SETUP — REVIEW OPTIMIZED FILES BEFORE USING THEM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY EXCLUSIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOKENCHEAT WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR (B) US $50. THESE LIMITS DO NOT APPLY WHERE PROHIBITED BY LAW.

11. Indemnification

You will indemnify us against third-party claims arising from your content, your violation of these Terms, or your violation of another party's rights, to the extent caused by you.

12. Termination

You may stop using the Service or delete your account at any time. We may suspend or terminate your access for material violation of these Terms, or discontinue the Service with reasonable notice. On termination we will delete or anonymize your personal data per the Privacy Policy. Sections 2 (estimate disclaimer), 7, and 9–13 survive termination.

13. Dispute resolution and governing law

These Terms are governed by the laws of the State of New Mexico, USA, without regard to conflict-of-law rules. Before filing a claim, contact us and we will try in good faith to resolve the dispute informally within 30 days. Disputes that cannot be resolved informally will be brought in the state or federal courts located in Bernalillo County, New Mexico, and you consent to their jurisdiction — except that either party may bring an individual claim in small-claims court.

14. Changes to these Terms

We may update these Terms. For material changes we will give at least 14 days' notice by email or prominent notice on the Service. Continued use after the effective date constitutes acceptance.

15. General

If a provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms plus the Privacy Policy are the entire agreement between us regarding the Service.
